PRE-EMPLOYMENT PERIOD


According to the Hachette dictionary of the French language, an internship is a period of learning, training or development in a company, service or association. It therefore allows anyone who has completed and obtained a secondary or higher education diploma to immerse themselves in professional realities in the field in a practical way.

When joining a business, service or association, the objectives are generally twofold.

For the first, it is about writing a report or a dissertation in order to support and obtain a diploma.

The second is to go through a period of apprenticeship / trial to ultimately be hired … In any case, the trainee has above all a status that must be respected by himself first and by the employer then.

But, in recent years, we have seen more and more in our regions that the rules governing the internship contract are no longer truly respected. Lack of knowledge of legal standards relating to the internship contract or the eternal problem of professional integration of our young professionals? The question remains. One thing is certain, our young graduates work in the same way as those already hired in companies. We note with bitterness internships that go beyond six months.

Speaking of the employment contract in Title III, this agreement stipulates in its article 14 (article relating to the probationary period): “The definitive engagement of the worker may be preceded by a probationary period stipulated in writing and of which the maximum duration varies according to the category to which the worker belongs. During the trial period, the parties have the reciprocal option to terminate the contract without compensation or notice. The maximum length of the trial period is set as follows: eight days for workers and hourly employees, one month for those paid monthly. For supervisors, technicians, engineers, executives, senior managers and their assimilated, the duration of the trial period starts from two to 6 months and is renewable only once « .

We will therefore deduce from this article that a defense internship like that of pre-employment starts from two to three months and is also renewable only once. The only difference lies in the level of remuneration, also known as the transport bonus, which is normally compulsory for the pre-employment internship. Regarding the defense internship, on the other hand, opinions differ on the level of remuneration and sometimes left appreciated by the employer.
